1. Purpose & Scope

This Domain Transfer Policy outlines the strict procedures and legal compliance requirements for transferring domain names managed by Web Care House Pvt Ltd to a client or third-party registrant.

This policy is based on:

  • Pakistan Law: Electronic Transactions Ordinance (2002), Prevention of Electronic Crimes Act (2016).
  • U.S. Law: Computer Fraud and Abuse Act (18 U.S.C. § 1030), Cybersecurity & Infrastructure Security Agency (CISA) best practices.
  • ICANN Regulations: Inter-Registrar Transfer Policy (IRTP), WHOIS Accuracy Program, and Registrar Accreditation Agreement (RAA).

2. Eligibility for Domain Transfer

A domain may only be transferred if all of the following are met:

  • ICANN Rule: Domain is at least 60 days old from registration or last transfer.
  • Financial Clearance: All dues, including renewal charges and Web Care House Pvt Ltd’s Domain Keeping Fee, are settled.
  • Legal Compliance: Transfer request must not violate PECA 2016 (Pakistan), CFAA (U.S.), or involve fraudulent cyber activity.
  • Ownership Verification: Request must be initiated by the verified registrant (as per WHOIS) or their authorized representative.

3. Documentation Required

To initiate transfer, the following must be submitted:

  • Domain Transfer Request Form issued by Web Care House Pvt Ltd.
  • Valid Government-Issued ID (CNIC for Pakistan; Passport/Driver’s License for U.S. registrants).
  • Proof of Domain Ownership (invoice, registrar account screenshot, or contract).
  • Authorization Letter (if representative is requesting on behalf of registrant).

4. Transfer Procedure

  1. Verification: Web Care House Pvt Ltd verifies ownership, identity, dues, and compliance with ICANN’s IRTP.
  2. Authorization Code (EPP): If approved, the EPP/Auth Code is issued within 7 business days.
  3. Registrar Unlock: Domain is unlocked for transfer.
  4. Transfer Execution: Client submits EPP code to new registrar; transfer may take 5–10 business days.
  5. Final Handover: Upon completion, Web Care House Pvt Ltd relinquishes all administrative and technical responsibility.

5. Restrictions

  • ICANN Restriction: No transfers allowed within 60 days of domain creation or prior transfer.
  • Expiry Restriction: Domains within 30 days of expiry cannot be transferred unless renewed first.
  • Legal Hold: Domains under investigation (PECA 2016 or CFAA cybercrime cases) cannot be transferred.
  • Disputes: Domains under UDRP (Uniform Domain-Name Dispute-Resolution Policy) cannot be transferred until resolved.

6. Fees

  • Domain Transfer Handling Fee: USD 25 per domain (non-refundable).
  • Outstanding Fees: Must be cleared prior to release.

7. Data Protection & Cyber Policy

  • Pakistan PECA 2016: All data involved in the transfer will be protected under the Right to Privacy provisions.
  • U.S. CISA & CFAA: Unauthorized access, data tampering, or fraudulent requests will be prosecuted under 18 U.S.C. § 1030.
  • ICANN WHOIS Policy: Registrant contact details must be accurate and updated before transfer approval.

8. Liability Disclaimer

After successful transfer:

  • Web Care House Pvt Ltd is not liable for domain misuse, loss, downtime, or cyber incidents.
  • Responsibility shifts to the new registrant/registrar under ICANN and respective national cyber laws.

9. Client Acknowledgment

By submitting a transfer request, the client agrees that:

  • They are the rightful registrant and compliant with Pakistan law, U.S. law, and ICANN policy.
  • They understand the process may take up to 10 business days.
  • They release Web Care House Pvt Ltd from all post-transfer obligations.
